General terms and conditions for the sale of value vouchers through the webshop

1. Scope These General Terms and Conditions (hereinafter referred to as “GTC”) govern the relationship between the operator of the webshop (hereinafter referred to as “Seller”), Vital- & Familienhotel Angerwirt, Familie Haitzmann, Dorf 40, A-5603 Kleinarl and the customer (hereinafter referred to as “Customer”) when selling value vouchers (hereinafter referred to as “Voucher”) via the webshop. The GTC apply to all sales of vouchers concluded via the webshop.

2. Conclusion of the contract The purchase contract is concluded by sending the customer’s order to the seller. The order constitutes a binding offer by the customer to the seller to purchase a voucher. The seller will inform the customer about the receipt of the order immediately by e-mail. The e-mail constitutes a declaration of acceptance by the seller.

3. Voucher price and payment The price for the voucher is indicated on the respective product page of the webshop. The price is inclusive of applicable sales tax and all other price components. The customer has the option to pay the voucher price by bank transfer or by using one of the payment methods offered on the order page.

4. Voucher validity The voucher is valid for a period of 12 months from the date of purchase. Beyond the validity period, the voucher expires without any right to a refund. The voucher is only redeemable in the webshop where it was purchased.

5. Redeeming the voucher The customer can redeem the voucher when placing an order in the webshop by entering the voucher code during the ordering process. The voucher can only be redeemed in full. A cash payment of the voucher value is not possible.

6. Liability The seller is not liable for any damage caused by the improper use of the voucher by the customer.

7. Changes to the GTC The Seller reserves the right to change these GTC at any time. The changes shall be notified to the customer in due time before they come into force. In the event of significant changes, the Seller shall send the Customer a separate notification. If the customer does not object to the changes within six weeks after receipt of the notification, the amended GTC shall be deemed accepted. The Seller shall expressly draw the Customer’s attention to this consequence in the notification.

8. Final Provisions Austrian law shall apply. In the event of a dispute, the competent court in Austria shall have jurisdiction. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, an appropriate provision shall apply which comes as close as possible to the economic purpose of the invalid provision.
